Broker registrations may be issued to either U.S. persons or foreign persons. Foreign persons should make the following substitutions when submitting their registration package:
Business Documentation: Include official business documentation from the country(ies) where business is located and conducted. If the documentation is not in English, a translated copy must also be provided.
Ownership: Describe that they are foreign non-U.S. persons and therefore, the business is foreign owned. Include the foreign person/ownership information in the Form DS-2032 statement of registration, Item 12, and also in the transmittal letter. If the registrant is not the actual sole owner of the business, the registrant should include the information regarding the other owners including the percentage of ownership and of control. Special attention should be paid to ITAR Section 126.1 regarding prohibited persons, entities and countries.
Citizenship: If the person listed in Block 7 has a U.S. visa or is U.S. permanent resident alien, the verifying documentation should be attached to the package and included in Block 7 of the DS-2032, where appropriate, and explained in the transmittal letter.
All other information required for export/manufacturing registration applies.
Payment: The registration fee payment must be drawn on a U.S. financial institution and must be denominated in U.S. dollars. The registrant's legal name and address must be identified on the payment. Payment through foreign financial institutions or payment denominated in foreign currency will not be accepted. Money orders and traveler's checks will not be accepted.
